Acceptance

These Terms and Conditions govern access to and use of the Bohio Maintenance application and related websites, messages, tools, and services. By creating an account, signing in, submitting a request, uploading content, receiving notifications, or otherwise using the application, you agree to these Terms and Bohio LLC's Privacy Policy. If you do not agree, do not use the application.

Purpose of the Application

Bohio Maintenance is a coordination tool for maintenance requests, scheduling, communications, estimates, media uploads, corporate partner qualification applications, and related property workflows. The application is not an emergency service, security service, construction warranty, insurance product, professional advice service, or guarantee that any request, repair, contractor, partner application, message, schedule, estimate, image, file, or notification will be accurate, timely, available, accepted, completed, or suitable. For emergencies, call 911 or the appropriate emergency authority.

Maintenance Guide and Troubleshooting Information

The application's maintenance guide, chat-style FAQ, automated suggestions, category suggestions, request prefill tools, and similar informational features are provided for general convenience only. They are not professional, technical, electrical, plumbing, HVAC, appliance, safety, environmental, legal, insurance, or emergency advice. They may be incomplete, incorrect, unavailable, outdated, or unsuitable for your specific property, equipment, condition, skill level, lease, local code, or safety situation.

You are responsible for deciding whether any step is safe and appropriate. Do not perform any troubleshooting step that you are not comfortable performing or that could create risk of injury, property damage, code violation, utility hazard, or further damage. Bohio LLC does not assume responsibility for actions you take or do not take based on guide content, automated responses, FAQ content, or request suggestions.

The application is not monitored as an emergency service. If there is fire, smoke, sparking, shock risk, gas odor, carbon monoxide alarm, flooding, sewage backup, structural danger, medical risk, threat to personal safety, or any other emergency or immediate hazard, leave the affected area if it is unsafe and call 911 or the appropriate emergency authority right away. Submitting a maintenance request is not a substitute for emergency services.

Accounts and User Responsibilities

You must provide accurate information, keep your login credentials secure, maintain access to your email and phone number, and promptly update incorrect account information. You are responsible for activity under your account and for all text, photos, files, estimates, notes, scheduling responses, and other content submitted through the application.

You may not use the application for unlawful, deceptive, abusive, harassing, unsafe, infringing, malicious, or unauthorized purposes. You may not attempt to bypass security controls, access another user's information, scrape data, interfere with service operations, upload malware, or submit false, misleading, confidential, privileged, or third-party information that you are not authorized to share.

Contractors and Third Parties

Contractors are independent persons or businesses and are not employees, agents, partners, or representatives of Bohio LLC unless a separate written agreement says otherwise. Bohio LLC does not guarantee contractor licensing, insurance, availability, workmanship, safety, estimates, pricing, timelines, materials, compliance, or results. Users are responsible for evaluating contractors, requests, access, safety conditions, estimates, approvals, and completed work.

Corporate Partner Applications

Corporate partner registration and qualification tools are provided so businesses can submit information for review by Bohio LLC or Bohio Management. Submitting an application, document, owner record, screening consent, or other material does not guarantee approval, a lease, a reservation, a business relationship, or any specific terms.

If you submit partner application materials, you confirm that the information is accurate to the best of your knowledge and that you are authorized to provide it. This includes business records, insurance documents, banking summaries, ownership information, contact information, government identification, and documents uploaded on behalf of owners, officers, guarantors, employees, or related entities.

Bohio LLC may use partner application materials to review qualifications, communicate about the application, maintain records, request screening, coordinate with service providers, and support related property or leasing workflows. You should keep your own copies of anything you upload because the application is not intended to be your only document archive.

Notifications

The application may send email and SMS/text notifications. Delivery is not guaranteed and can fail because of carrier filtering, user device settings, third-party outages, incorrect contact information, spam filtering, or other conditions. Message and data rates may apply. By providing a phone number, you consent to receive operational text messages related to your account and maintenance activity. You may request that Bohio LLC remove your phone number from the account.

User Content and Uploaded Media

You retain ownership of content you submit, but grant Bohio LLC a non-exclusive, worldwide, royalty-free license to host, store, copy, display, transmit, process, and use that content as reasonably necessary to operate, secure, support, investigate, improve, and document the application and related maintenance, partner application, and property workflows. Do not upload sensitive personal information, financial account data, government identification numbers, medical information, or content you do not have authority to submit unless the application specifically asks for that type of document as part of a partner qualification workflow.

No Warranties

The application and all related services are provided "as is" and "as available." To the fullest extent permitted by law, Bohio LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, error-free operation, data availability, message delivery, data recovery, security, accuracy, completeness, and suitability for any maintenance, business, legal, safety, or property-management purpose.

Data, Availability, and Security

Bohio LLC uses reasonable administrative and technical measures designed to operate and protect the application, including access controls and selected encryption or hashing for sensitive partner application information where supported. No internet service, software, database, email system, SMS system, cloud provider, or storage service is perfect. The application may be unavailable from time to time, and uploaded files or records may be delayed, incomplete, corrupted, deleted, or unavailable.

You are responsible for keeping your own copies of important records and uploaded documents. Bohio LLC is not responsible for loss or unavailability of data caused by user conduct, reused passwords, compromised email or phone accounts, incorrect uploads, third-party providers, carriers, networks, devices, browsers, contractors, tenants, landlords, or events outside Bohio LLC's reasonable control.

Limitation of Liability

To the fullest extent permitted by law, Bohio LLC and its owners, officers, managers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages; lost profits; lost rents; lost business; loss of use; loss of goodwill; property damage; personal injury; replacement services; data loss; security incidents; failed notifications; missed appointments; incomplete repairs; contractor acts or omissions; tenant acts or omissions; or service interruptions, even if advised of the possibility of those damages.

To the fullest extent permitted by law, Bohio LLC's total aggregate liability for all claims relating to the application or these Terms will not exceed the greater of one hundred dollars (US $100) or the amount you paid directly to Bohio LLC for application access in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions or limits, so some limits may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Bohio LLC and its owners, officers, managers, employees, contractors, service providers, and affiliates from claims, damages, losses, costs, liabilities, penalties, and expenses, including reasonable attorneys' fees, arising from or related to your use of the application, your content, your breach of these Terms, your violation of law, your property access decisions, your maintenance decisions, your communications, or your dealings with tenants, landlords, contractors, or third parties.

Suspension and Changes

Bohio LLC may suspend, restrict, modify, discontinue, or refuse access to any part of the application at any time, with or without notice, including for security, legal, operational, nonpayment, misuse, or maintenance reasons. Bohio LLC may update these Terms. Continued use after updated Terms are posted or accepted means you agree to the updated Terms.

Governing Law and Disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules, unless applicable law requires otherwise. Any dispute must be brought individually and not as a class, collective, consolidated, or representative action, to the fullest extent permitted by law. Before filing a claim, you agree to first contact Bohio LLC and try to resolve the dispute informally.
